⚖️ Supreme Court candidacy decisions: Sami Abu Shehadeh ultimately announced his resignation after Chief Justice Yitzhak Amit said a Supreme Court majority favored disqualifying him and recommended that he withdraw his candidacy. The Joint List initially signaled rejection before moving toward withdrawal to avoid a disqualification ruling. Itamar Ben Gvir appeared as an attorney arguing for disqualification.
According to Amit Segal’s reporting, Justice Stein said he understood Abu Shehadeh’s article as encouraging terrorism of the kind seen on October 7. Asked to identify an English-language article in which he called Hamas a terrorist organization, Abu Shehadeh answered: “There is no such article.”
Justice Kabub said Abu Shehadeh had condemned the murder of anyone, including soldiers. Justice Vilner disputed that he had included soldiers. Vilner also urged Amit to let Abu Shehadeh’s lawyer answer during an exchange.
Segal criticized the effort to secure withdrawal instead of a ruling, contrasting it with Amit’s insistence on issuing a ruling after Ronen Bar resigned as Israel Security Agency (Shin Bet) chief. He argued that withdrawal would avoid establishing a precedent under Section 7A and leave the justices’ positions and reasoning undisclosed. Citing the earlier decision allowing Heba Yazbak to run despite praising Dalal Mughrabi and Samir Kuntar, Segal attributed the apparent shift to public pressure. These were his assessments of the court’s approach.
The court majority allowed Ofer Cassif to run, with Justices Mintz and Stein dissenting in favor of disqualification. The justices unanimously allowed Ra’am and the Joint List to contest the elections.
During arguments for disqualifying Ra’am, Kabub challenged Gottlieb by citing Netanyahu’s negotiations with Mansour Abbas, Abbas’s meeting with Rabbi Druckman and the prospect of a coalition agreement.
⚖️ Tropper defends Abu Shehadeh’s removal: Hili Tropper described his position as values-based and shared across nearly the entire political spectrum. He accused Abu Shehadeh of encouraging further attacks after October 7, citing the statement: “If little Gaza managed to do it, others can do it more simply and effectively.”
Tropper rejected claims that this position merely followed Netanyahu and said the same principle underpinned his insistence that future government partners support eliminating Hamas. Citing affected communities and fallen and serving soldiers, he also reiterated opposition to a Palestinian state because of the risk of a similar outcome in Judea and Samaria.
