️ Reported military preparations: The Wall Street Journal reported Tuesday night that Washington warned several Gulf countries to prepare for a possible “short and intense” campaign against Iran after the Nov. 3 U.S. midterms. U.S. forces are reinforcing missile defenses, replenishing ammunition and preparing bombers and fighters. President Trump is leaning toward a major attack on infrastructure and nuclear facilities but has made no final decision. Israel is also preparing for renewed strikes, the report says.
Ynet reports that IDF Chief of Staff Lt. Gen. Eyal Zamir blocked Netanyahu’s push for Iran strikes before Israel’s elections over timing, not the operation itself. Netanyahu has said of Iran: “it is not over yet.”
⚖️ Caretaker government’s war powers: Neither bloc appeared to have a majority as votes were counted Wednesday, Ynet reports. Netanyahu’s outgoing government remains until a successor is formed; he emphasizes that Likud remains the largest party.
Ynet’s legal analysis says Section 40 of Basic Law: The Government treats regular and caretaker governments alike. War or significant military action likely to lead to war requires government approval or, under delegated authority, Security Cabinet approval. The prime minister cannot decide alone.
Ynet cites Guardian of the Walls and Breaking Dawn as caretaker precedents, but both were limited operations responding to specific intelligence warnings, not broad wars initiated by Israel. It assesses that judicial intervention would likely be limited and government or Security Cabinet war approval likely unanimous. Neither is an announced decision.
️ Political warnings and coalition stakes: Addressing defense and public-service leaders after polls closed Tuesday, Yashar! chairman Gadi Eisenkot called Netanyahu “a caretaker prime minister, without a mandate or confidence” and warned: “Netanyahu, don’t you dare use Israel’s security for your political needs.” He said he would seek a “Zionist government committed to universal conscription” and called another election a mistake.
Ynet says fighting could reshape coalition talks before the Knesset’s swearing-in around Nov. 10 and during presidential consultations on who should form a government. War could encourage unity or emergency government, as before the 1967 Six-Day War and after the October 2023 outbreak of the Swords of Iron war.
Netanyahu’s critics fear influencing government formation could be an objective of military action. Ynet stresses there is no public evidence of such intent; these are commentators’ and opponents’ assessments. It also suggests renewed fighting could help Trump press for unity, citing sources close to him who called a government including Otzma Yehudit chairman Itamar Ben-Gvir “not an option.”
️ Restraint, appointments and public resources: Attorney general guidelines and Supreme Court rulings require caretaker governments to balance continued activity and urgent needs against restraint. Ministers and authorized officials must consult ministry legal advisers on decisions outside routine administration. Unnecessary, irreversible decisions that could constrain successors, narrow partisan actions and use of state power or resources for unfair political advantage should be avoided.
Attorney General Gali Baharav-Miara previously said: “It is neither possible nor appropriate to freeze government activity.” Essential action requires less restraint; decisions are assessed individually.
Public appointments should generally be avoided during elections, but there is no absolute ban, including on senior appointments. Orderly legal review must follow established professional guidelines, not election-specific rules, weighing necessity against electoral-law principles.
